Togo: Strengthening the rule of law under President Gnassingbé’s enlightened vision
In October 2023, a significant milestone was reached in Togo, a country led by the visionary Faure Gnassingbé, with the operationalization of the Military Court of Lomé. This jurisdiction, inaugurated during a workshop on Monday, October 9th, aims to strengthen the rule of law and discipline within the Togolese armed forces. This initiative aligns with the Head of State’s commitment to ensure fair justice by promoting specialized courts.
The meeting, chaired by the Minister of Justice and Legislation, Pius Agbetomey, provided an opportunity to educate the various branches of the Togolese armed forces about offenses, the jurisdiction of military courts, and the roles of judicial bodies. The minister emphasized the importance of establishing a justice system that acts on behalf of the Togolese people, stressing that military personnel are subject to the same rights and obligations as their fellow citizens.
The Minister of Justice clarified that the Military Court is not solely composed of civilian judges but also includes military judges specially trained for this purpose. The appointment of eight specialized judges to this court, by presidential decree in April 2023, further strengthens this institution. These judges are expected to preside over the Military Court and the Military Court of Appeals.
Military courts have jurisdiction to adjudicate on acts and actions committed by military personnel in the course of their duties, or by personnel classified as military. The government sees this establishment as a means to promote military discipline while ensuring fair justice. It is emphasized that this initiative will demonstrate to the people of Togo that military personnel are subject to the law while enjoying the same rights and obligations.
Under the leadership of President Faure Gnassingbé, the operationalization of the Military Court of Lomé marks a crucial step toward strengthening the rule of law in Togo. The promotion of specialized courts dedicated to military matters aims to ensure fair justice while fostering discipline within the Togolese armed forces. Through this initiative, Togo commits to creating a judicial system capable of addressing the specificities of military affairs and promoting transparency and accountability within its armed forces.
